Do not say: "Applying the Sharia" but "Establishing the Sharia".
Why? A few days ago, there was a conversation between me and a brother who said something very beautiful that I wanted to share with you. - The term "Applying the Sharia" is not found in the Book or the Sunnah, and it has been media-sensationalized and burdened with meanings we do not intend. In addition, it has an intellectual harm: - The word "application": meaning the applier and the applied upon, which is what the ruler does to the ruled. Therefore, you will find many people deeply ingrained in their minds that the Sharia is something to be "applied," which is not within their power, but within the power of those who can "apply" it. - This is an incomplete understanding and a superficial entry into the meaning of the Sharia, and evidence of this is that if you ask someone: "When did the Prophet (peace be upon him) "apply" the Sharia?" they will say: "In Al-Madinah," because they do not understand the Sharia except in terms of judgment, whereas the Prophet (peace be upon him) "established" the Sharia from the very first moment. - The most accurate term and the one found in the Quran is the term: "Establishment": - ((That you establish the religion and do not divide therein)). - If we tell people "Establishing the Sharia," this has many benefits: First: The blessing of the text, as Allah the Almighty said ((That you establish the religion)). Consider what the word "establishment" conveys in terms of tranquility of the soul and depth of meaning, as it includes the meaning of construction, uprightness, gentleness, and patience. This is the blessing of the Quranic words, and why not, as He revealed it from the knowledge of the hearts and their secrets, Glorified is He. Second: It clarifies to people that establishing the Sharia is not limited to the aspect of judgment. The Prophet (peace be upon him) established the Sharia from the moment of his first mission, and so are we tasked with it. Therefore, we are not individuals or entities "demanding the application of the Sharia" but individuals and entities who establish the Sharia directly. Establishing the Sharia today for us is a call, and tomorrow with the ability, it is jihad. If empowerment occurs, then establishing the Sharia will come with empowerment in judgment. - Why do we limit it to judgment only? Then, based on that, we demand its application? So that people understand that they are not addressed by it, and that it is something that is demanded from the rulers. - Also, the term "application" has instilled in them a negative feeling towards the Sharia as if it is being applied to them from above, as if it will fall upon them like lightning! Therefore, they ask: (We are not against applying the Sharia, but who will apply it?!) "Establishing the Sharia" is a term that indicates that everyone will establish it, ruler and ruled, shepherd and flock, and it is not something that some impose on the heads of others. Third (which is very important): The term "Establishing the Sharia" indicates that some should not deviate from the methodology in periods of non-empowerment for the sake of reaching the application of the Sharia!! Because they will realize that they are being addressed to establish the Sharia, not commanded to merely demand its application or to attempt an act that is forbidden to reach judgment to apply the Sharia!! Therefore, from today, we address people and call them to establish the Sharia, not to demand its application! We call them to establish it themselves instead of calling them to support those who will apply it. And Allah the Almighty knows best. Finally, I would like to say that the owner of this profound speech and insightful vision is my beloved brother, Engineer Ahmad Samir. May your prayers be with him that Allah preserves him, suffices him from the evil of criminals, guides him, and benefits through him.
