The Laws of Retribution in Islam
Okay, when people are truly obedient to Allah, and if divorce happens, what happens after that? Allah the Almighty says: "And We ordained therein for them: life for life, eye for eye, nose for nose, ear for ear, tooth for tooth, and wounds retribution."
Question: Is the punishment left to human judgment so that we can make it harsher or not? Have you not heard the saying of Allah the Almighty: "And We ordained therein for them: life for life, eye for eye, nose for nose, ear for ear, tooth for tooth, and wounds retribution." The legal ruling is retribution. If the rightful owner wants to waive it voluntarily on his own, then as Allah the Almighty says: "Whoever gives it up, it is an expiation for him," meaning Allah will reduce his sins thereby. But the right remains for him to take retribution or forgive. This is the Sharia of our Lord, the Almighty.
In the hadith narrated by Bukhari, a Jew attacked a girl during the time of the Messenger of Allah, peace be upon him. He took her ornaments and crushed her head, meaning this criminal broke her head. Her family brought her to the Messenger of Allah, peace be upon him, and she was in her last breath and had become silent, meaning she could not speak. So the Messenger of Allah, peace be upon him, said to her: "Who killed you? So-and-so?" meaning someone other than the one who killed her, and she indicated with her head that no. He said: "Then mention another man to her," and she indicated that no. He said: "So-and-so?" about her actual killer. Just as he did with the girl, retribution, a daughter of a man, a woman of a man, the ruling is retribution.
And in the hadith narrated by Bukhari also, O noble ones, that Al-Rabi'ah, the aunt of Anas bin Malik, broke the tooth of a female servant from the Ansar, just a tooth. The people demanded retribution, so they came to the Prophet, peace be upon him, and the Prophet ordered retribution. A tooth, yes, and yet he ordered retribution. But the people later accepted compensation, meaning a substitute.
The Muslim is honored, O people, whether male or female, and his right is preserved in the Sharia, and whoever wants to transgress against him has a deterrent that restrains him from his greed and aggression.
Applying Sharia and Supplication
O noble ones, this heart-rending crime is one of the results of our societies neglecting the Sharia of their Lord, the Almighty, in its rulings, in its view of divorced women, in choosing a spouse, in dealing with family problems, in everything. And Allah is our helper.
So we ask Allah to return us to Him in a beautiful return, because by Allah, we do not see it as very ugly, very ugly, very painful, it is unbelievable, a stage of savagery unprecedented in history. And Allah is our helper. And we ask Allah the Almighty to be gentle with this sister, to be gentle with her and her children who witnessed this painful incident, and to bind their hearts and lighten their burden. And we ask Him the Almighty to enlighten the insight of this sister and compensate her with good, and to grant her the sight of the bliss of Paradise. And Allah is our helper.
