One Phrase Invalidates the "Reassuring" Amendments to the Child Law!
Peace be upon you, and the mercy of Allah.
Introduction: Poisons in the Child Law
Do you want to know why the child law is poisonous in most of its provisions? Do you want to know why the phrase "according to the current legislation" and the amendment added to some of the law's articles "without contradicting religious values" have no real value and do not remove the poison from the law?
To know, look at just one article from the law, Article Thirteen, which was approved by the committee tasked with studying the law in the House of Representatives, and is being discussed and voted on today by the entire council.
Article Thirteen After the Amendment
The article after the amendment states: "The child who is temporarily or permanently deprived of his family environment has the right to alternative care by a decision of the competent judicial authority, and the Ministry of Social Development, in coordination with the competent authorities, shall take the necessary measures for this in accordance with the relevant legislation, provided that the best interest of the child is taken into account, provided that the best interest of the child is taken into account."
Look at this phrase: "the best interest of the child." What is the problem? And who among us does not want the best interest of the child? Poor thing, this is the end of those who do not know that they are dealing with a poisonous law.
Definition of "The Best Interest of the Child"
Do you know that this phrase "the best interest of the child" has been defined in a booklet of forty pages? When we searched for the definition of the best interest of the child on the website of the authority that issued the law, which is the National Council for Family Affairs, we found that there is a document on its website titled "Guidance Manual for Applying the Principle of the Best Interest of the Child." But we found that the document has been deleted from its link on their website. You click on the word or the title and nothing appears. It is deleted and we do not know the reason for the deletion, especially at this critical time.
The Mizaan Foundation and Its Guide
This poisonous phrase "the best interest of the child" is simply a prelude to taking your children from you for various reasons, including your poverty. The text that prepares for the removal of children was mentioned in this guide by the Mizaan Foundation with a phrase very similar to that in the Child Law, which expressed the matter in a twisted way, where the Mizaan guide says: "According to Article Nine of the Convention - meaning the Convention on the Rights of the Child - it is not permissible to separate the child from his parents against their will unless the competent authorities decide that the separation is necessary to preserve the best interests of the child, to preserve the best interests of the child."
The guide states in more than one place that "the best interest of the child" overrides all other provisions. Therefore, all additions "without contradicting religious values" and "in accordance with the current legislation" have no value, because it will be said simply that these restrictions contradict the best interest of the child.
Origins of the Term and Its Interpretations
According to the Mizaan guide, the term "the best interest of the child" is based on the text of the United Nations Convention on the Rights of the Child, which made this alleged interest one of the most important general interpretive principles governing, one of the most important general interpretive principles governing, meaning that it prevails and is superior in case of conflict, not for Islamic Sharia values nor for the terms contained in local laws even if they are similar in name.
But who knows the best interest? It is the competent authorities that know it according to the standards of the United Nations. And we will publish a detailed video, God willing, which clarifies that at the top of the priorities of the best interest is that the child enjoys his or her right to fornication, or to change his gender, or to practice his deviance, or to immigrate to distant countries away from his righteous societies after the competent authorities have tempted him to do so.
And the Mizaan study confirms that, in accordance with the Child Convention, narrow religious interpretations should not prevent the child from enjoying his rights and best interests. And the Mizaan guide emphasizes that the best interest may require taking the child away from his parents if it is in his best interest, such as if they are poor. Thus, it interprets what is stated in the United Nations Convention, which says: "Article Nine of the Convention on the Rights of the Child allows the child to be separated from his parents to protect his best interests, as in the case of abuse by his parents or their extreme poverty if it hinders the child's growth and development." Instead of helping the family after they have taken away people's resources, no, now it becomes the right of these competent authorities to demand the removal of the child from his poor parents.
Also, the Mizaan guide prepares for taking the boy or girl from their parents if the parents practice harmful traditional practices with the children, including of course teaching them to preserve modesty, honor, and dignity.
The Amendment to the Child Law and Its Implications
The amendment to the Child Law has not been addressed, but it has been added "by a decision of the competent judicial authority," so that the child is removed from his parents by a judicial decision, as happens in France, and not by a decision of other institutions, as happens in Social Sweden.
The Mizaan Foundation published its guide in 2012 and held workshops in Jordan after that to spread its ideas. The author of the guide indicated that allowing marriage before the age of eighteen without allowing sexual relations is contrary to international laws. And Mizaan stated that it prepared its guide to ensure the consideration of the concept of "the best interest of the child" in the upcoming law when it is approved. They are waiting for this law to be approved, waiting for it to start implementation. There are lawyers waiting to sue you because you are violating the United Nations standards in raising your children.
In conclusion, the law allows the competent authorities to corrupt your children and interfere in their upbringing if you want to raise them contrary to the sexual morals that the United Nations wants. And they can submit a request to the judicial authorities to remove your children from you.
And all the phrases "without contradicting religion, customs, values, current legislation, relevant legislation," drink their poison, because they contradict "the best interest of the child" as defined by the competent authorities and the United Nations.
This is one of the models included in the law, whose appearance is bright and whose core is poisonous, and there are many such models, and we are ready to clarify them and demand a public debate to prove them, but they avoid that. Who would accept that this crime is passed through his hands after this? Therefore, we repeat and emphasize: The Child Law is poisonous.
Peace be upon you.
